Right of Withdrawal and Returns

1. Right of withdrawal

If you are a consumer (a natural person purchasing goods for a purpose unrelated to economic or professional activity), you have the right to withdraw from goods purchased under a distance contract within 14 calendar days, without stating a reason.

The withdrawal period begins on the day you or a person designated by you (other than the carrier) took possession of the goods. If several goods in one order are delivered separately, the period is counted from the day the last item is received.

To exercise the right of withdrawal, you must inform us of your decision to withdraw from the contract before the end of the period, using an unequivocal statement (for example, an email to info@duuna.lv) or the withdrawal form attached below.

2. When the right of withdrawal does not apply

In accordance with Cabinet of Ministers Regulation No. 255 “Regulations Regarding Distance Contracts”, the right of withdrawal does not apply, among other cases:

• to goods made to the consumer’s individual specifications or clearly personalised (for example, furniture with individually selected dimensions, material, finish, colour or configuration);
• to goods that deteriorate or expire quickly;
• to goods which, for health or hygiene reasons, are not returnable if they have been opened after delivery;
• to goods which, after delivery, have been inseparably mixed with other items;
• in other cases provided for by laws and regulations.

3. Procedure for exercising the right of withdrawal

1. Inform us of your withdrawal within 14 days by writing to info@duuna.lv or by sending a completed withdrawal form.
2. Send or hand the goods back to us without undue delay and no later than 14 days from the day on which you notified us of your withdrawal.
3. The goods must be returned complete, with the original packaging and accompanying documents.

4. Condition of goods and liability for diminished value

You are liable for any diminished value of the goods if the goods have been used other than as necessary to establish their nature, characteristics and functioning. You may inspect and examine the goods in the same way as you would in a physical store, but you may not use them fully.

For example, furniture may be unpacked and inspected, but assembling it fully, using it or damaging it may reduce the value of the goods, and in such a case we are entitled to withhold compensation for the diminished value from the amount to be refunded.

5. Cost of returns

The direct cost of returning the goods is borne by the Buyer. As furniture is a large-format item that, by its nature, cannot be returned by post, the return cost may be significant and depends on the size of the goods and the carrier’s tariffs. You can find out the approximate return cost in advance by contacting us.

6. Refund

If the withdrawal is justified, we will refund the payments received, including delivery costs (except for additional costs arising if you chose a more expensive delivery method than the standard delivery offered by us), without undue delay and no later than 14 days from the day we received your notice of withdrawal.

We may withhold the refund until we have received the goods back or until you have provided evidence that the goods have been sent back, whichever occurs earlier.

The refund is made using the same means of payment you used for the original transaction, unless you have expressly agreed to a different method.

7. Lack of conformity of goods (guarantee)

Irrespective of the right of withdrawal, the consumer has the right, within 2 years of purchase, to submit a claim regarding a lack of conformity of the goods with the terms of the contract in accordance with the Consumer Rights Protection Law. In such a case, please contact us describing the non-conformity and enclosing proof of purchase.

8. Withdrawal form

Complete and send this form only if you wish to withdraw from the contract. The form can be sent to info@duuna.lv. The form is also available for download in Word format.
